The following Terms and Conditions include important information about the services, your rights as Passengers and other important information.

  • For booking and transport services (together “the services”) provided by Cross car Hire Ltd, you are contracting directly with Cross car Hire Ltd for the provision of the services.
  • In order to provide the services, Cross car Hire Ltd accepts booking as a private hire vehicle operator (under the relevant private hire vehicle operating licence) for the purpose of private hire legislation and regulation in the United Kingdom.
  • These Terms form a contract between you, the Passenger, and Cross car Hire Ltd, a licensed private hire vehicle operator, who accepts booking requests from you and enters into a contractual obligation to provide you the transportation services to complete the journey which is the subject of the booking.

We update the Terms and Conditions as and when required by the private hire legislations and regulations in the United Kingdom.

Cross car Hire Ltd sets out to provide a safe reliable service to all its customers. We will always try to be fair and reasonable to our customers and promote goodwill where possible. We value hearing from you and are always interested in learning about ways we can improve the Service.

DEFINITIONS

The words used herein mean the following:

  • 1998 Act”means the Private Hire Vehicles (London) Act 1998.
  • "Services" means the services provided to you by Cross car Hire Ltd consisting of: (a) access to Cross car Hire Ltd office and telephone contact which enable you to request and receive transportation services; and/or (b) payment collection and payment processing services allowing us to charge you and to pay charges into the bank account of Cross car Hire Ltd, as the case may be.
  • “Booking” means booking of Cross car Hire Ltd transportation services.
  • “Legislation” means the Acts and any regulations made pursuant to the Acts, including any related local government regulations pertaining to the operation of PHVs.
  • "PHV" means private hire vehicle.
  • “Passenger” means the customers who utilise our services (“you”)
  • “Cross car Hire Ltd ” means Cross car Hire Ltd (“we” or “us”)
  • “Transportation services” means the provision of passenger journey which is the subject of a booking accepted by Cross car Hire Ltd as set out in these Terms.

TERMS

General

  1. Overview
    1. These terms cover your access and use of services provided by Cross car Hire Ltd (the “Terms”).
    2. You are provided reasonable notice of these Terms at the time of the booking and you are duly informed that these Terms are available to you on request (a) at the time of booking, (b) after booking confirmation, and (c) at the time of your journey which is the subject of the booking as the drivers have a copy available to be provided during the journey.
    3. By using Cross car Hire Ltd Services, you confirm you accept these Terms. If you do not agree to these Terms, you may not access or use Cross car Hire Ltd Services.
    4. If we have to contact you, we will do so by phone call, text message or email, using the details you provided to us when booking your journey.
    5. Unless otherwise agreed separately in writing, the services provided by Cross car Hire Ltd are made available to you for your personal non-commercial use in the United Kingdom only.

 

  1. Privacy Notice
    1. Cross car Hire Ltd collects, uses and disclose information from or about you as and when needed when providing services to you. We will notify you when such notices apply to you.

 

  1. Charges and Payment
    1. If you make a booking through Cross car Hire Ltd, you agree to pay the relevant charges as described and will be responsible for any charges or fees linked to your booking.
      1. Depending on, but not limited to, an estimate of miles and times incurred by the driver, the time of day of travel and the type of vehicle required to do a specific journey, the charges may vary.
      2. All quotes, where given, are an estimate and the final amount charged may be different from the estimate.
  • We operate fixed rates for journeys to or from the local areas to: the London airports and to most London postal codes. We reserve the right to vary the fixed rates from time to time.
  1. Most journeys are quoted travelling via the shortest route. If the route varies from this, e.g. by request from you to use a motorway route or the driver has to avoid a traffic related problem, we reserve the right to charge you for any extra mileage and time.
  2. You may be charged supplementary charges, costs and/or fines, for your use or misuse of our services (such as repair or cleaning fees).
  3. In some cases, if the services provided by Cross car Hire Ltd cannot be perfumed due to your action or inaction (for example, if you are not present at the pick-up location), cancellation charges may apply in line with our cancellation policy.
  1. We also reserve the right to apply a surcharge to
    1. airport and station pickups;
    2. out of area to out of area journeys;
  • Christmas, New Year and other Bank Holiday journeys;
  1. additional stops on route;
  2. periods of extreme weather or road conditions;
  3. journeys out of standard business hours; or
  • peak hours.
  1. Also note, all London airports and other airports now make a drop off charge, to anyone dropping off passengers to the airport. This charge will be passed on the customer at the rate the airport levies this charge. All airport pickups will incur a parking charge, which we try and minimise by arranging a predetermined pickup time and keeping an eye on the flight landing time. However, what the car park charge is levied at, this will be pass on to you. As these charges are variable, we cannot build them into our pricing structure and are added to the journey cost at the end of the journey.
  2. Where a driver has to wait beyond the appointed time to collect you, whether it be your fault or arises from circumstances beyond your control, you will be liable to pay Cross car Hire Ltd for the waiting time.
  3. Transport for London (TfL) has decided to levee a congestion charge to all private hire vehicle. The customer is liable for this charge and will be add to the journey cost and will only be charged at Congestion Charge period of activation.
  4. Transport for London (TfL) has decided to make a ULEZ charge to certain types of vehicle. We at Cross car Hire Ltd in line with our environment policy work to ensure that all of Fleet vehicles comply to these conditions. However as some of our fleet include self-employed drivers, we will occasionally have to make the ULEZ charge to you. This will be added to the cost of the journey at the end of the journey.
  5. The charges do not include tips. Where available, you may pay tips, either in person or through the bank transfer. We will collect tips paid through bank transfer from the relevant journey on your behalf and remit them to the driver who carried out your journey.
  6. We will notify you of the relevant charges as and when needed.
  7. At the end of the journey, which is the subject of your booking, the driver informs us the time, mileage and any further charges incurred in line with the above terms. Cross car Hire Ltd Car then confirms the final price and informs the driver who acts as our agents in collecting fare where payment is made in cash.
  8. Where you wish to make a payment through bank transfer, Cross car Hire Ltd will facilitate you to make payment using this method. If your payment method(s) are unavailable, we reserve the right to continue to try to take payment.
  9. Charges are inclusive of applicable taxes including VAT unless specifically stated otherwise.

 

  1. Cancellation Policy
    1. Cross car Hire Ltd assume a booking request is valid until you cancel the journey with a member of staff in the offices of Cross car Hire Ltd and receive confirmation by the member of staff that it is cancelled.
    2. We may also refuse booking requests and cancel the booking if (a) there is a reasonable doubt about the correctness or authenticity of the request including incorrect information regarding a pickup place or time or about the contact information and (b) our staff, including the assigned driver, are satisfied that they are unable to carry out the booking request. Until then, we take all reasonable care to complete the booking request.
    3. In the event of a cancellation of a booking, Cross car Hire Ltd may charge a cancellation fee for any costs incurred until the time when it is apparent that Cross car Hire Ltd have been satisfactorily informed of a cancellation of booking or Cross car Hire Ltd  have been unable to contact you.
    4. Usually there would be no charge for a booking cancelled prior to dispatch.
    5. Where a booking is cancelled after the driver has been dispatched, you may be liable for a charge, calculated as per the rule in the following paragraph. Also, where the driver is unable to find you after making all reasonable efforts, a cancellation fee may be charged.
    6. The cancellation fee is calculated to pay for the time, miles and incidental costs including but not limited to loss of earnings and expenses of our assigned driver in the event of cancellation.

 

  1. Termination of the Contract
    1. In line with the cancellation policy, you may terminate these Terms and the Contract between you and Cross car Hire Ltd.
    2. We may terminate these Terms and the Contract and your access to the services provided by Cross car Hire Ltd with immediate effect if we conclude that there is a breach by you of these Terms or any other agreement between you and Cross car Hire Ltd.
    3. If we cannot charge the relevant charges to your payment method, we may suspend or remove your access from services provided by us until payment is made.
    4. You must immediately pay any outstanding charges due by you upon termination. Any such charges will survive termination and we reserve all rights to collect payment after termination.
    5. Where there is a booking accepted by Cross car Hire Ltd prior to the date of termination, and the journey subject to the booking is to occur after the date of termination, Cross car Hire Ltd shall also terminate the booking, unless Cross car Hire Ltd , in its absolute discretion, agrees to continue to perform the journey subject to the booking. In such circumstances, Cross car Hire Ltd shall submit an invoice upon the performance of the journey which shall be payable by you immediately upon completion of the journey.

 

  1. Your liability and Indemnity
    1. You are liable for any damage suffered by us as a result of your violation of these Terms, your misuse of services or your violation of any laws.

 

  1. Limitation of Liability
    1. Whilst we will exercise all due care and consideration to carry out instructions provided by you for the provision of providing transportation services, we will not be liable for any incidence or loss due to circumstances beyond our reasonable control.
    2. Nothing in these Terms limits or excludes any liability which cannot legally be limited or excluded, including liability for death or personal injury caused by negligence and liability for fraud or fraudulent misrepresentation or alters your rights as a consumer that cannot be excluded under applicable law.
    3. Cross car Hire Ltd , its affiliates, directors, officers, employees and/or workers are not liable for delay or failure in performing any of its obligations under these Terms where any such delay or failure is as a result from vents or circumstances beyond the reasonable control of either party provided that, as soon as reasonably practicable after (or during) the occurrence of the relevant event, Cross car Hire Ltd Car notifies you of the nature, impact and likely duration of the relevant event (to the extent that it was reasonably known) and uses all reasonable and best endeavours to mitigate or reduce the impact of the relevant event.
    4. Cross car Hire Ltd, and its affiliate, are not liable for business losses. Our booking and transportation services are provided only for private use. If you use our services for any commercial or business purpose, we will have no liability to you for any loss of profit, loss of business, loss of revenue, business interruption, or loss of business opportunity (whether or not such loss could be reasonably expected to flow from our negligence or breach of these Terms).

 

  1. Dispute Resolution Process
    1. In the event of a dispute, we would ask you to raise a complaint using the contact details in the “About us” section above.
    2. There may be circumstances in which we are unable to provide you with information about the complaint whilst an investigation is ongoing (by us and/or a third party such as the police).
    3. In the unlikely event that we cannot resolve the dispute, we will work with you to discuss a way forward to resolve the dispute, which may include mediation.
    4. Cross car Hire Ltd reserves its right to refer the dispute to the court when needed.

 

Cross car Hire Ltd SERVICES

Booking services

  1. Your access to and use of the services
    1. You are responsible for obtaining the network access necessary to use the services and are responsible for any rates and fees from your mobile network provider.
    2. We provide the services “as is” and “as available.” The services may be subject to limitations, delays, and/or other problems inherent to the use of the internet and electronic communications and are not guaranteed to be available, uninterrupted or error free at all times.
    3. You must provide us with certain personal information to register, including your name, phone number and email address.
    4. You may need to provide additional information relevant to carry out the booking request such as your address and/or the address of pickup, address of drop off, date and time of the day.

Transportation services

  1. Service provider and Private Hire Vehicle Operators of Cross car Hire Ltd Transportation Services
    1. For Cross car Hire Ltd transportation services within the United Kingdom, you will be contracting with Cross car Hire Ltd Ltd which has accepted your booking as the licensed private hire operator.
    2. You can contact us by using the contact details in the “About us” section above.
    3. Pursuant to the Legislation, a booking request made by you can only be accepted by a person that holds a private hire operator's or booking office licence.
    4. In respect of the 1998 Act, Cross car Hire Ltd is the holder of the relevant PHV operator’s licence.

 

  1. Cross car Hire Ltd Contract with you for Transportation Services
  2. A request for a booking constitutes an offer by you to purchase our transportation services in accordance with these Terms. This booking request will set out the main characteristics of the transportation services (including pick up and drop off points). Your offer shall only be accepted when Cross car Hire Ltd issues written confirmation via text message and/or email that your booking is confirmed subject to our Terms and Conditions, at which point and on which date and time a contract for Cross car Hire Ltd  transportation services to which the booking relates shall come into existence (“Contract”).
  3. The booking confirmation message includes confirmation of the booking address, date and time. The message also confirms the assigned driver’s details including name, vehicle registration number, vehicle details including model, size, colour, and a link which directs you to the driver’s picture.
  4. There is no obligation on us to accept a booking and it may be declined for any reason. If a driver becomes unavailable after we have provided you with written confirmation of the Contract, we will endeavour to find you another driver for your Booking. Where an alternative driver cannot be found, we reserve the right to terminate the Contract without compensation to you.
  5. Under the Contract, Cross car Hire Ltd agrees to provide the services which include:
    1. Accepting and processing bookings requested by you, but without prejudice to our sole and absolute discretion to decline any such request and/or cancel an accepted booking;
    2. Identifying a driver to complete your journey;
  • Assigning the booking to a driver;
  1. Keeping record of bookings;
  2. Remotely monitoring transportation services booked by you through our driver’s app to ensure safety of both the passengers and the drivers; and
  3. Receiving and dealing with feedback, questions and complaints from you relating to Bookings accepted by us.
  1. Under the Contract, Cross car Hire Ltd shall deliver the services in accordance with the degree of skill and operating practice expected of an experienced provider of private hire operators providing booking and transportation services to passengers. Cross car Hire Ltd shall also ensure that the services are performed with due care and skill and shall use all reasonable and best endeavours to ensure that the services are carried out by a qualified, skilled, experienced, licensed and insured driver.
  2. We will inform you of the estimated time of driver arrival and estimated time of journey completion, but these are estimates only and time shall not be of the essence. If we cannot accept your booking request, we will inform you of this and will not charge you for transportation services. Your contract will end when the passenger journey ends or as otherwise may be provided for in these Terms.
  3. The price for the contract (which will include VAT, if applicable) will be provided to you at the time of placing your booking request. However, as provided previously, this is just an estimate, and the final price will be confirmed to you at the end of the journey which is the subject of your booking. The price for the contract may include relevant surcharges (including airport pickup, drop off, tunnel tolls, parking or other airport charges) and/or tolls, road charging schemes, including congestion charge, charges for low emission or similar zones, and road tax. You may be charged a different amount than the price provided in certain situations, including but not limited to, material changes to the pick/up drop off point, route taken,driver waiting time, stops or traffic. In this situation, the rates that will apply will be available to you as and when they arise. It is your responsibility to remain informed about our charges (found under Section 3) and the current rates for the transportation services.
  4. Additional charges may also apply, for instance if you, or any passenger, soils, contaminates, or damages a vehicle, in which case you may be charged for such damage, as well as for a reasonable cleaning fee.
  5. Under the contract, you undertake to pay the charges you have incurred as part of your journey as and when they arise.
  6. Our accepted payment method includes cash payment and bank transfer. When you make a booking request, you can either agree to pay in cash to the assigned driver at the end of the journey or make a bank transfer. In case of bank transfers, if you think the amount charged from your bank account is incorrect, please contact us promptly to let us know.
  7. Cross car Hire Ltd may make changes to the transportation services at any time, including to reflect changes in relevant laws and regulatory requirements.
  8. Your right to cancel a contract depends on when you decide to end the contract. Please see Section 4 of General Terms for our Cancellation Policy. If we are not at fault, and you do not have a right to change your mind, you can still end your contract, but you may be charged a cancellation fee in accordance with our cancellation policy. To cancel your contract, please contact us on the contact details provided in the “About us” section above. We will make refunds due to you as soon as possible, where applicable.
  9. We may end your contract in certain circumstances, as provided for in these Terms. If we end the contract, we will refund any money you have paid in advance but may deduct or charge you as compensation for the net costs incurred if you have broken the terms of the contract.
  10. A person who is not a party to these Terms and/or Contract shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any Terms of the Contract.

 

  1. Problem with your Cross car Hire Ltd Transportation Services
  2. If there is a problem, or if you have a complaint, please contact us on the details set out in the “About us” section above.
  3. A reasonable amount of luggage may be allowed to be carried in the vehicle where this was specifically requested by you at the time of booking. A suitable vehicle will be provided for these purposes. However, where in the reasonable opinion of the driver, the luggage amounts to an excessive weight, or poses a threat or danger to the driver, the vehicle or passengers, the driver, acting as our agent, may refuse to carry such luggage.
  4. All parcels, packages and goods are taken at your own risk. It is your responsibility to ensure adequate insurance cover is in place for goods in transit. Cross car Hire Ltd shall not be responsible for any property left by you in any vehicle. Cross car Hire Ltd accept no responsibility for any loss or damage to your property (unless caused by Cross car Hire Ltd  and/or any of our assigned drivers). Where property is found, Cross car Hire Ltd  will all reasonable and best endeavours to try and return he property and will store this for a period of one month and will be entitled to deal with this appropriately in its absolute discretion as Cross car Hire Ltd  sees fit.
  5. Additionally, you will be liable for any damage to vehicles, fittings or equipment, caused through negligence, misconduct or any default of the passenger and/or other persons travelling with the passenger.
  6. Cross car Hire Ltd reserves the right (and delegates the right to its drivers) to refuse to carry any person who is thought to be under the influence of alcohol or drugs and/or whose behaviour is considered to pose a threat to the driver, the vehicle, or other passengers.
  7. During the journey, you are also not permitted to:
    1. i) Smoke, consume alcohol or drugs;
    2. ii) Engage in any other illegal activity; and/or
  • iii) Carry any animal (except for registered guide dogs) save for where permission was requested and granted at the time of booking, and where permitted, the animal is carried in a suitable cage and/or as appropriately restrained.
  1. Please note, however, that all private hire vehicles are required by law to hold and maintain PHV insurance for drivers to legally carry and transport passengers. If your problem relates to a motor incident, please contact us for your driver's insurance details to progress matters. We will not be liable for any matters covered by your driver’s PHV insurance unless and until you have exhausted all potential remedies related to motor accidents.
  2. For our liability in relation to business losses, please see Section 7.d above.
  3. We do not exclude or limit liability in any way to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, workers, agents or subcontractors, for fraud or fraudulent misrepresentation and for breach of your legal rights in relation to the transportation services.

 

  1. Governing Law and Jurisdiction
    1. These Terms shall be exclusively governed by and construed in accordance with the laws of England. If you live in England or Wales, you can bring legal proceedings in respect of the Services in the English courts.
